In California, the mechanics' lien is considered so important to compensation of parties in the building trades that the right is enshrined in the state Constitution.

Article XIV, Section 3 of the California Constitution provides:

“Mechanics, materialmen, artisans, and laborers of every class shall have a lien

upon the property upon which they have bestowed labor or furnished materials,

for the value of such materials, for the value of such labor done and materials

furnished; and the Legislature shall provide by law, for speedy and efficient

enforcement of such liens.”

Because there are generally numerous parties involved in a building project, a mechanism for orderly compensation other than lawsuits based on direct contracts is needed. Subcontractors do not have a direct contract with the property owner, so they cannot go to court to sue to enforce contractual rights.

You must have been properly licensed at the time you furnished labor or materials in order to file a mechanics' lien. You must comply with the law in regard to providing notice to the property owner, and other processes. Our firm can help in filing a mechanics' lien.

Once you perfect your lien, the owner cannot sell the property without paying you. This is strong incentive to do so. You may also sue to foreclose on the lien, although it may not be worthwhile unless you are owed a substantial amount.
